1. General

These terms and conditions ("Terms") apply when you, as a legal entity, i.e. a trader ("You") place an order with Nordic Motor Center by telephone, e-mail and on associated pages, ("The Site"). Agreement is concluded between you and Nordic Motor Center AB, organization number 5567586895 ("Nordic Motor Center"). Detailed contact details and other information about Nordic Motor Center can be found on the Site. The terms and conditions are only applicable to you who are a legal person, i.e. a trader and who place orders by telephone, e-mail and via the site.

1.2

In order to be able to order products or services from Nordic Motor Center, you must be 18 years of age. According to Swedish law, Nordic Motor Center does not accept credit purchases for people under the age of 18. Nordic Motor Center reserves the right in individual cases to refuse or change your order (for example if you have provided incorrect personal data and/or have payment remarks).

1.3

Nordic Motor Center works hard to avoid final sales and possible image and writing errors on the Site, for example errors in product description or technical specification, incorrect prices and price adjustments (such as changed prices from suppliers or currency changes) or incorrect information regarding whether a product is in stock. Nordic Motor Center has the right to correct any such errors and to change or update the information at any time. If an incorrect price has been entered for a product that you have ordered, Nordic Motor Center will of course notify you of this and wait for your approval of the corrected price before Nordic Motor Center continues with the order. All image information on the Site must be viewed exclusively as illustrations. Such illustrations cannot be guaranteed to represent the number of products You will receive or the product's exact appearance, features or origin. Nordic Motor Center is not responsible for information on the Site that comes from a third party.

1.4

The site, as well as all content on it, is owned by Nordic Motor Center or its licensors. The information is protected by, among other things, intellectual property and market laws. This means that trademarks, company names, product names, images and graphics, design, layout and information about products, services and other content may not be copied or used without written approval from Nordic Motor Center.

2. Agreement and Order

2.1

In order to make a purchase via the Site, you must accept the Terms and Conditions. By accepting the Terms and Conditions, you undertake to follow the Terms and Conditions in their entirety, as well as agree that you have read the information about personal data and consented to the use of personal data and cookies in accordance with Nordic Motor Center's Privacy Policy. Nordic Motor Center complies with PUL's regulations regarding handling of personal data.

2.2

A purchase agreement is only concluded when Nordic Motor Center has confirmed your order and you have received order confirmation from Nordic Motor Center by e-mail. Nordic Motor Center encourages you to save this order confirmation for any contacts with Nordic Motor Center customer service. You can cancel your order until it has been confirmed by Nordic Motor Center. If the order is cancelled, Nordic Motor Center will refund any payments that have been received regarding the order. Nordic Motor Center reserves the right to cancel orders without prior notice.

3. Personal data

3.1

Nordic Motor Center recommends that you create a user account before shopping on the Site. When you register your user account and/or place an order, you will be asked to provide certain personal data. You confirm that the information you fill in is correct and complete and are responsible for incorrectly filled information. Information about Nordic Motor Center's processing of personal data can be found in Nordic Motor Center's privacy policy.

3.2

You undertake to ensure that no one else can use your login details. You may not disclose username and password to any unauthorized person and must ensure that documents containing information about username and password are stored in such a way that unauthorized persons cannot gain access to the information. You must immediately notify Nordic Motor Center if it is suspected that an unauthorized person has gained access to your password. You are responsible for all purchases made with your login details if such notification has not been made.

3.3

If Nordic Motor Center suspects that you are abusing your user account, your login details or otherwise breaching the Terms and Conditions, Nordic Motor Center has the right to suspend you. Nordic Motor Center also has the right to assign you new login details.

4. Prices, fees and payment

4.1

When ordering via the Site, the prices specified on the Site apply. Prices are stated in Swedish SEK and are exclusive of VAT. Prices do not include payment and shipping fees, which are listed separately at checkout.

4.2

Nordic Motor Center has the right to payment already in connection with the order. Ordered products, both undelivered and delivered products, remain the property of Nordic Motor Center until the products have been paid for in full. The validity period of a credit invoices from Nordic Motor Center AB is limited to the due date of the credit invoice. After the credit invoice's due date the credit invoice is invalid, and it can neither be deducted when paying, nor requested to be paid out.

When you pay via Paypal, this is administered by Paypal. Company details, contact details and complete terms of use regarding Paypal can be read here.

Card payment

If you choose to pay with a Swedish bank card, debit card or credit card, there is no additional payment fee. If you choose to pay with a foreign bank card, debit card or credit card, a fee of 2% is added to the total amount of the purchase. We accept payments by Visa and MasterCard.

For card payments, we use the payment provider Paypal. When you make your payment, you will be transferred to an encrypted page at Paypal where the payment takes place. No processing of card numbers takes place at the store.

How a card purchase works:

When you have selected the products you want to buy and clicked through to checkout, you first fill in your personal details/log in.
Then select card payment as payment method and click "Finish purchase"
The page will reload and you will be forwarded to a secure page where you will be given additional fields to fill in.
Make sure that all your card details are correct before you click on to complete the purchase.
The money is debited from your card (which means you won't have access to the money but it hasn't been debited yet).
The payment gateway that all card payments go through meets the requirements for PCI-DSS.

Advance payment via bank transfer

If you choose advance payment via bank transfer when you order from us, we do not charge any additional payment fees. The advance payment is made to Nordic Motor Center's bank account in Swedbank via a bank transfer.

How advance payment via bank transfer works:

When you have selected the products you want to buy and clicked through to checkout, you first fill in your personal details/log in.
Next, select advance payment as the payment method and click "Complete purchase"
When you have completed your order, we will send a separate e-mail with our bank details and instructions on how to make your advance payment to us.
When we have received your payment, you will receive a confirmation by e-mail that we have received your payment.

Nordic Motor Center reserves the right not to always offer all payment methods, or to change the payment method if the one you as a customer have chosen for some reason does not work at the time of purchase. Please note that any restrictions on payment options are stated on the Site. Offers on the Site are valid for a limited time and while stocks last.

Security

We use SSL (Secure Socket Layer), which is a security protocol for secure data transfer over the Internet (or other networks).

The SSL protocol creates an encrypted channel between sender and receiver. The encryption ensures that no one can manipulate data (MessageIntegrity).

The SSL protocol uses digital certificates to control transmitter and / or server authentication (Server Authentication)

Receipt and Warranty Certificate

Your invoice, which you receive from us on e-mail and mail after purchase, works both as a receipt and warranty certificate.

5. Promotions and offers

Nordic Motor Center may from time to time offer promotions on the Site that may have more favorable terms than what appears in these Terms, e.g. regarding payment or extended right of withdrawal. These more favorable conditions apply as long as the campaign is active and for the specific products specified by Nordic Motor Center in connection with the campaign. Nordic Motor Center reserves the right to withdraw such promotions at any time. In the event of termination or cancellation of a campaign, these Terms apply without modification. Offers on specific products on the Site are valid for a limited time and while stocks last.

If you have a discount code, use it at checkout. Enter the discount code when you get to checkout, then the amount will be automatically deducted from the total amount of your order.

6. Shipping and delivery

6.1

Nordic Motor Center delivers products worldwide. Shipping costs are always added to the price of the product. The current shipping cost for the product is shown at checkout depending on which country the product is to be delivered to. Nordic Motor Center reserves the right to price changes on freight without prior notice.

6.2

The return shipment of the old core is included in the charged shipping price. All return shipments must be done with DHL and with the attached shipping documents on the product from Nordic Motor Center. Return shipping carried out in other ways is not reimbursed.

Contact our transport department to obtain new return shipping documents for the return shipping of the old frame if they have been removed. Enter your order number to simplify the handling of the case.

6.3

The expected delivery time of the product is shown on the current product page on the Site and on the order confirmation. The delivery time stated is an estimated delivery time. If Nordic Motor Center cannot deliver a product within the specified expected delivery time, you will be informed of the delay and informed of a new expected delivery time. Nordic Motor Center is not liable for late or missing goods. More information about Nordic Motor Center deliveries of goods can be found under delivery and returns here.

Collection at Nordic Motor Center

As a customer, you always have the opportunity to collect your order from us completely free of charge. Choose collection at checkout and you will not be charged shipping costs. When your order is ready for collection, you will be notified via email that the product is ready for collection. To pick up your order, bring your order number and valid ID document.

Transport damage

Should all or parts of your order be damaged upon delivery due to damage during transport, this must be notified to our transportation department, select order as a subject in your message. Enter your order number to simplify the handling of your case.

Track your shipment

When your order leaves our warehouse, you will receive an e-mail with a link and a KolliID for your delivery so that you can track the goods.

7. Cancellation rights and returns

7.1

When purchasing products on the Site, 14 days cancellation rights applies for consumers. This means that you as a consumer have the right to cancel your purchase by notifying Nordic Motor Center within 14 days of receipt of the ordered product (the cancellation deadline).

7.2

When returning products with broken seals or products without original packaging or if the product is in a changed condition, Nordic Motor Center will make a price deduction for the reduction in value of the returned product.

Examples of price reductions:

When returning products with a broken seal, Nordic Motor Center will make a 100% price deduction for the reduction in value of the product when it has become unusable or unsellable.

When returning a product without original packaging or manual, Nordic Motor Center will make a 100% price deduction of the value of the product.

When returning a product that has been assembled, used, incurred wear or the like, Nordic Motor Center will make a 100% price deduction of the value of the product.

7.3

In connection with an order for goods for which rights of regret does not applie, you will receive very clear information about this. If a product has been sealed, you may not break the seal if you wish to exercise your rights of regret. If you still choose to use your rights of regret, Nordic Motor Center will make a 100% price reduction for value reduction.

7.4

If you wish to cancel the purchase, you must return your goods to Nordic Motor Center before the expire date, as indicated below on this page.

7.5

When using the right of withdrawal, you pay the return freight. You are responsible for the condition of the goods until received by Nordic Motor Center. You can also leave your return freight to Nordic Motor Center, free of charge. The product should be returned within 14 days from the date you received your order from Nordic Motor Center. The product should be shipped well packaged, in good condition and in original packaging. Returns must be made to Nordic Motor Center according to the methods and instructions listed below.

If you wish to use the right of withdrawal after your purchase, your order must be received or retrieved. If you want to undo your purchase after the delivery has been announced, but before you have picked up the order (unresolved package), contact our customer service. If you have chosen to pick up your package at Nordic Motor Center, you will not pay for the return, but still need to contact Nordic Motor Center to cancel your order. An unresolved package is not considered as the right of withdrawal.

7.6

You as a customer pay the return shipment and are responsible for the risk of return; this risk includes, inter alia, the product being damaged or getting lost during the return back to us.

7.7

When you regret your purchase, Nordic Motor Center will refund the amount you paid for the item, including the shipment. You as a customer will be responsible for any return shipment to us. On the amount to be refunded, Nordic Motor Center is entitled to deduct a sum corresponding to the lost value of the goods in relation to the original value of the goods, due to the fact that you have handled the goods to a greater extent than necessary to determine its qualities or function.

7.8

Nordic Motor Center will repay the amount as soon as possible, but no later than 14 days from the date Nordic Motor Center has received your notice of the right of withdrawal. Nordic Motor Center may, however, wait for the refund until Nordic Motor Center has received the goods and examined its condition. The refund will be made to you through the payment method that you chose, if nothing else is agreed or there isn't any holdback to such a refund.

8. Old core and old core charge

Nordic Motor Center sells exchange units, which means that when you buy a product from our range, we take your old product in return. Your old product is referred to by Nordic Motor Center as an old core. As a guarantee to get the old core, Nordic Motor Center charges an core charge in addition to the price of the product.

When Nordic Motor Center has received the old chassis in return, the entire core charge is credited and refunded, with the exception of the following:

In case of visible damage of the old core, only half of the core charge will be refunded.
If the old core isn’t returned in the transport frame or the package that the goods where received in, only half of the core charge will be refunded.
When the return of the old core does not correspond to the delivered one, only half of the core charge will be refunded.
In case of failure to empty coolant/engine oil from the product that leads to leakage during transport. Only half of the core fee will be refunded.
The old core must be returned to Nordic Motor Center within 30 days from the invoice date. Otherwise, the entire old core is considered expired and will not be refunded.

The credit invoice of the old core charge shall primarily be used and deducted when paying an open debit invoice. If you do not have an open debit invoice to deduct the credit invoice against, you must provide your bank details in writing by post or e-mail to: administration@nordicmotorcenter.se, and the credit invoice will be paid to you as soon as possible. The validity period of a credit invoices from Nordic Motor Center AB is limited to the due date of the credit invoice. After the credit invoice's due date the credit invoice is invalid, and it can neither be deducted when paying, nor requested to be paid out.

9. Warranty, Claim and Limitations of Liability

9.1

Some of Nordic Motor Center's products and services may be covered by warranty. Different products and services have different warranty periods. Compensation for labor costs is included in some of the guarantees according to Nordic Motor Center's terms of purchase in the event of an approved complaint. Information about the warranty period and whether labor costs are included in the warranty for the current product or service can be found on the product page on the Site. If a warranty has been provided for a product or service, you will find information about the warranty period and whether labor costs are included in the warranty on your order confirmation and invoice. If a warranty has been provided for a product or a service, the right to complain is as long as the warranty period for the respective product or service.

Repair work within the warranty period may not be carried out or even started without Nordic Motor Center's written consent, otherwise the warranty and the right to complain will cease to apply. Warranty claims or complaints cannot be made before full payment has been made for the product.

Warranty for products only covers original production and material defects, and thus not defects that occur during or after an own change of the product's function and appearance, such as rebuilding, upgrading or other configuration of the product. Your invoice is valid as proof of warranty. The warranty period is calculated from the invoice date.

The warranty does not apply to damage caused by:

Incorrect installation
Mismanagement
Accident
Racing and competition use
Normal wear/deterioration

9.2

Customers who wish to make a complaint regarding an error in an ordered product must always make a complaint notification on the Site here. Complaints that are made within one month from when you discovered the error are always considered to have been submitted in time.

9.3

Nordic Motor Center tries in first hand to repair the product still remaining in the car. If the problem can't be solved with the product still fitted in the car, the product must be sent to Nordic Motor Center for inspection. Nordic Motor Center will response to the complaint within 30 days from receiving the product.

You as a customer pay the return shipment and are responsible of the return. This includes, inter alia, the product being damaged or getting lost during the return shipment. The item must always be marked with the invoice number.

9.4

Nordic Motor Center reserves the right to deny a complaint if it turns out that the product is not faulty or that the cause of the fault in the product did not arise due to a manufacturing fault.

If Nordic Motor Center approves the complaint and labor costs are included in the warranty, you will be reimbursed according to Autodata's time frame. The maximum amount to be paid per hour is 875:- SEK including VAT. The highest total amount to be repaid is 18 750:- SEK excluding VAT. In the event of an approved complaint, you will be compensated for the return shipping with SEK 500 excluding VAT for products up to 35 kg and with SEK 2 375:- including VAT for products over 35 kg. Salvage costs, travel costs, overnight accommodation costs, rental car costs, downtime compensation, loss in business activities are not reimbursed. Direct or indirect losses due to personal injury, property damage, damage to property other than the product delivered by us are not compensated.

In the event of an approved complaint, compensation is paid within 30 days from the day Nordic Motor Center approves the complaint. 10. Responsibility

Nordic Motor Center assumes that you who buy a product have the necessary knowledge regarding the assembly of the ordered product. You are responsible for the delivered product being assembled in a professionally correct manner. Unprofessional work can cause considerable danger to the user. Claims for damages regarding the consequences of incorrect use/assembly are not taken into account.

Nordic Motor Center recommends that our customers always read the respective product's instructions.

11. Links

Nordic Motor Center may link to other websites that are outside of Nordic Motor Center's control, and websites outside of Nordic Motor Center's control may link to the Site. Although Nordic Motor Center tries to ensure that Nordic Motor Center only links to websites that share Nordic Motor Center's personal data and security regulations according to the Privacy Policy, Nordic Motor Center is not responsible for the protection or confidentiality of information or personal data that You provide on other websites. You should exercise caution and read the personal data regulations for the relevant Site.

12. Force Majeure

Nordic Motor Center is not responsible for delays caused by circumstances beyond Nordic Motor Center's control, such as, for example, general labor disputes, war, fire, lightning, terrorist attack, changed authority regulations, technical problems, errors in electrical/telecommunications/data connections or other communications and failure or delay in services from subcontractor due to circumstance specified herein. These circumstances shall constitute a basis for exemption which entails exemption from damages and other penalties. If any such situation were to arise, Nordic Motor Center will inform you partly at the beginning and partly at the end of the time for the current situation. If this leads to a delay in delivery, both you and Nordic Motor Center have the right to cancel the purchase with immediate effect.

13. Changes of the Terms

Nordic Motor Center reserves the right to make changes to these Terms and Conditions at any time. Any changes to these Terms will be posted on the Site. Changes apply from the moment you have accepted the Terms (in connection with a new purchase or when visiting the Site), alternatively 30 days after Nordic Motor Center has informed you of the changes. However, Nordic Motor Center recommends that you keep up-to-date on the Site regularly to be aware of any changes to the Terms and Conditions.

14. Invalidity

If a competent court, authority or arbitration panel should find that any provision of these Terms is invalid or unenforceable, the provision in question and all other provisions shall be valid and enforceable to the extent permitted by applicable law. The provisions declared invalid or unenforceable will be replaced by relevant legal guidance and advice.

15. Applicable law and dispute

15.1

Disputes must primarily be resolved by consensus after discussion with Nordic Motor Center's Customer Service.

15.2

Disputes concerning the interpretation or application of these Terms and Conditions shall be interpreted in accordance with Swedish law and ultimately decided by a general Swedish court in Helsingborg.
